OLD LYME ZONING COMMISSION
REGULAR MEETING
Wednesday– October 14, 2015, 7:30 P.M.

1.  Convene Meeting; announcement of voting members.

CONTINUED PUBLIC HEARING:

1.  Petition to Amend the Zoning Regulations to add in Section 3 of the Old Lyme Zoning Regulations the definition of “school” which is as follows:  School – Any structure, the use of which meets State licensing requirements for accredited primary, secondary or college instruction and education.  Such school may be public or private and is a permitted structure and use in all zoning districts.”  

A Motion was made by J. Johnson, seconded by S. Winchell to CLOSE the Public Hearing on the Petition to Amend the Zoning Regulations to add in Section 3 of the Regulations the definition of “School”.  No discussion and a vote was taken:  In favor:  J. Cable, J. Johnson, J. Marsh, G. Soucie, S. Winchell  Opposed:  None  Abstaining:  None  The motion passed unanimously. 5-0-0

REGULAR MEETING:

1.  Petition to Amend the Zoning Regulations to add in Section 3 of the Old Lyme Zoning Regulations the definition of “school” which is as follows:  School – Any structure, the use of which meets State licensing requirements for accredited primary, secondary or college instruction and education.  Such school may be public or private and is a permitted structure and use in all zoning districts.”  

A Motion was made by J. Johnson, seconded by G. Soucie to modify the definition of school to be the wording suggested by Zoning Commission counsel in his letter dated August 3, 2015.  The definition approved is as follows:  School – A use which meets State of Connecticut licensing requirements for accredited primary, secondary or college instruction and education.  Such school may be public or private.”  The effective date is November 18, 2015.  No further discussion and a vote was taken:  In favor:  J. Cable, J. Johnson, J. Marsh, G. Soucie, S. Winchell  Opposed:  None  Abstaining:  None  The motion passed unanimously. 5-0-0

2.  Special Permit to demolish the existing building at #149 Boston Post Road and construct a new 7,430 s.f. mixed use building (retail and restaurant on the lower level and professional office on the upper level) with an 18’ x 25’ outdoor dining patio on the property.  The second existing building on site at #151 Boston Post Road will remain unchanged.  A total of 64 parking spaces, new well, septic, stormwater management and other associated improvements are also proposed.   Graybill Properties, LLC, 151 Boston Post Road, Applicant.  

A Motion was made by J. Johnson, seconded by G. Cable, J. Marsh, J. Johnson, G. Soucie, S. Winchell  Opposed:  None   Abstaining:  None  The motion passed unanimously. 5-0-0

5. Approval of Minutes  –  Minutes of the Public Hearing and Regular Meeting of September 16, 2015

A Motion was made by S. Winchell, seconded by J. Johnson to Approve the Minutes of the Public Hearing and Regular Meeting of September 16, 2015 as submitted.  No discussion and a vote was taken.  In favor:  J. Cable, J. Johnson, S. Winchell   Opposed:  None   Abstaining:  J. Marsh, G. Soucie   The motion passed. 3-0-2

A Motion was made by J. Johnson, seconded by G. Soucie to adjourn the October 14, 2015 Regular Meeting.  The meeting adjourned at 7:55 p.m.
